Role Profile Job Title: Clinical Claims Manager (FTC 12 months) Business Unit: State Claims Agency Reports to: Senior Claims Manager, CIS Claims **Closing Date for applications 8th June*** Summary of the Business The NTMA provides a range of asset and liability management services to Government. These services include borrowing on behalf of the Government and management of the National Debt, the State Claims Agency, NewERA, the Ireland Strategic Investment Fund, the Future Ireland Fund and the National Development Finance Agency. It also assigns staff and provides business and support services and systems to the National Asset Management Agency, the Strategic Banking Corporation of Ireland and the Home Building Finance Ireland. The NTMA is designated as the State Claims Agency (SCA) when performing the claims management and risk management functions delegated to it under the National Treasury Management Agency (Amendment) Act 2000. The SCA's principal objectives are: The SCA is obliged by statute to manage delegated claims and counterclaims in such manner as to ensure that the liabilities of the State authorities are contained at the lowest achievable level. In performing this function the SCA seeks to act fairly and ethically in its dealings with people who have suffered injuries and who take legal actions against the State or State bodies, and the families of these people; and To implement targeted personal injury and property damage risk work programmes to mitigate litigation risk in State authorities and healthcare enterprises, in order to reduce the costs of future litigation against the State. The SCA is obliged by statute to manage claims for legal costs, and recovery of legal costs however such costs are incurred. The SCA's remit covers personal injury and third-party property damage risks and claims relating to certain State authorities including the State itself, Government ministers, the Attorney General, the Health Service Executive, the voluntary healthcare sector, An Garda Sochna, the Irish Prison Service, the Defence Forces and community and comprehensive schools. It also manages third-party costs arising from certain Tribunals of Inquiry. Role Summary The Claims Manager is accountable for the management of clinical negligence claims by reference to the Clinical Indemnity Scheme. Principal Accountabilities The principal accountabilities associated with the role will include: Responsible for management of assigned portfolio of clinical claims against the State under the Clinical Indemnity Scheme. Responsible for investigation and evaluation of each claim assigned and for seeking guidance from senior colleagues on direction as appropriate. Proposes approach for investigation and resolution of case and will implement subject to approval. Liaises with solicitors and other third parties to seek guidance on most appropriate approach to claim. Selects solicitors, barristers and experts for case and will attend meetings with the relevant State authority. Responsible for ensuring timely processing of all claims, ensuring documentation is accurate. Responsible for assisting health authorities, hospitals in respect of managing/assisting with coronial inquests. Acts as a daily contact for State authorities assigned to provide advice and guidance on issues pertinent to the Clinical Indemnity Scheme. Provides medical legal advice to all hospitals within the assigned portfolio. May allocate work to administrators but has no supervisory responsibilities. Experience Experience managing medical defence litigation with a minimum of 5 years' experience. Third level and/or professional qualification. Skills Relationship management skills Excellent communication skills, written and verbal Negotiating and problem-solving skills IT skills commensurate with principal accountabilities including knowledge of NIMS, iManage and other relevant systems Ability to work collaboratively with others, both inside and outside the organisation Pension Abatement If an appointee has previously been employed in the Civil or Public Service and that appointee is entitled to or in receipt of a pension from the Civil or Public Service or where a Civil/Public Service pension comes into payment during the appointee's re-employment that pension will be subject to abatement in accordance with Section 52 of the Public Service Pensions (Single Scheme and other Provisions) Act 2012.
